Here you can read the terms and conditions that apply, when you purchase items through Madklubben shop. By accepting your purchase at the Madklubben shop, you agree to our terms and conditions regarding the Madklubben Shop. We encourage you to read the terms and conditions before purchasing any items.

The Madklubben Shop is run by Madklubben ApS, CVR no .: 37284599, Østergade 22, 3rd floor, 1100 Copenhagen C.

Age

You must be at least 18 years old to do any purchase including alcohol. This also applies to tickets for events with beverages / wine menus described in the purchase agreement. When ordering / purchasing any of these you confirm that you are 18 years or older.

Prices

The price of your purchase is the price you find at shop.madklubben.dk at the time you complete the purchase.

All prices are in Danish kroner (DKK) including VAT.

Payment

The Madklubben shop receives payment with following payment cards:
·      Dankort
·      Visa Dankort
·      eDankort
·      Mastercard
·      Mastercard-Debit
·      Visa
·      Visa Electron
·      American Express

Credit card fee: Commercial cards issued within or outside of EU/EØS and private cards issued outside EU/EØS will be charged a fee. All transactions on American Express cards are surcharged.

All purchases will include a transaction fee of 1,39 Danish kroner (DKK). This fee will also appear in the summary of your purchase.

Your credit card details will be encrypted and sent directly to the bank by a secure connection.

The payment will first be deducted when your purchase has been sent off.

Delivery and delivery costs

Most purchases sold from the Madklubben Shop must be picked up at our restaurants. It will be clearly stated in the individual campaign whether a purchase must be picked up or will be delivered.

Purchases from the Madklubben Shop which are to be shipped will be delivered by Post Danmark, GLS Packing Shop or another responsible company and will be shipped as soon as possible. We expect a delivery time of 3-5 business days after you have received the order confirmation.

We use Post Danmark as the primary distributor of physical products. Deliveries can both be distributed to the nearest post office and to one of Post Danmark’s package boxes. The delivery method is stated in each campaign. You will receive a text message and an e-mail when you can pick up your purchase. Remember to bring along your ID. The price will depend on the weight and size of your purchase. To get an impression of the price of delivery with Post Danmark we refer to Post Danmark’s website.

You can also choose GLS ParcelShop as distributor. Deliveries with GLS ParchelShop is primarily sent to the parcel shop near the specified shipping address. You will receive a text message and an e-mail when you can pick up your purchase. Remember to bring along ID.
The price will depend on the weight and size of your purchase. To get an impression of the price of delivery with GLS ParcelShop we refer to GLS ParcelShop’s website.

Any delivery expenses will be charged by the costumer unless otherwise stated in the campaign.

Delivery will follow an invoice confirming that you have payed for the purchase.

Tickets purchased at the Madklubben Shop will be delivered electronically as an PDF file to your e-mail. You must print the tickets yourself and bring them to the purchased event.

Warranty

The general terms and conditions of the Danish purchase law apply to all purchases from the Madklubben Shop. This means, among other things, that you have 2 years’ right of warranty on purchases from the Madklubben Shop. The 2 year period runs from the purchase delivery. Contact the Madklubben Shop at shop@madklubben.dk quickly if you find any defects or discrepancies regarding your purchase delivery. The complaint will be processed if you complain within two months after the lack or error has been discovered.

In corporation with our customer service, we’ll agree on delivery of the correct purchase, a possible refund and reimbursement of your shipping costs.

Please notice that the determinations of the Danish purchase law doesn’t apply when purchasing tickets from the Madklubben Shop as it is a service. Therefore, please contact us immediately if you experience any problems when purchasing tickets.

Right of cancellation

When you do a purchase at the Madklubben Shop you have as a consumer 14 days’ right of cancellation. If you wish to use this right of cancellation in connection with a purchase, you must clearly inform Madklubben ApS within 14 days after receiving the purchase.

To inform Madklubben ApS you can use the standard withdrawal form, which you’ll find here.
Alternatively: You also have the option to fill in and submit the cancellation form on our website. If you choose this method we’ll immediately send you an e-mail, acknowledging that you wish to use your right of cancellation. You must then return the purchase to us without unnecessary delay and no later than 14 days from the day you have informed us, that you wish to withdraw the purchase.

You pay the shipping costs yourself when returning the purchase. If the purchase can’t be returned by regular mail, it is necessary…..
If you wish to use the right of cancellation you must notice that 1) the item is returned in a proper packaging (we prefer to receive the return in the original packaging), 2) the invoice or delivery note of the purchase must be included in the return, and 3) you must include information regarding the bank account to which your entitled amount should be transferred to.

If you choose to use this right of cancellation, see above, we’ll refund the price you’ve paid for the purchase including the original shipping costs without unnecessary delay and under all circumstances within 14 days from the date we have received notice of your decision to withdraw your purchase.
The Madklubben Shop, however, reserves the right to withhold the refund until we receive either the returned purchase or documentation stating that the purchase has been returned, whichever comes first.

You are responsible for the eventual deterioration of the product value, due to inappropriate handling.

Unless explicitly agreed otherwise, we make the refund with the same payment method which was used for the purchase. Under all circumstances, you won’t be charged any fees concerning the refund.

Please notice that the 14 days’ right of cancellation doesn’t apply to the following purchases at the Madklubben Shop:

·      Delivery of purchases which are expected to be deteriorated or obsoleted quickly, such as fresh foods or refrigerated goods.
·      Delivery of sealed purchases which, for reasons of health or hygiene, are not suitable for return, and where the seal has been broken after delivery.
·      Purchase of tickets for the following services:
–     Catering, eg. restaurant visits and delivery of food/catering from Madklubben’s restaurants.
–     Passenger transport, eg. travel by bus, train, taxi etc. to or from Madklubben’s resturants.
–     Accommodation, eg. stay at hotels, hostels etc. when visiting Madklubben’s restaurants.
–     Leisure facilities, eg. concerts, theater shows or movie shows at Madklubben’s restaurants.

Return address

If you wish to return a purchase due to defects or lacks or if you wish to use your right to cancellation, you must return the purchase and a copy of the order confirmation to:

Limitation of responsibility and proviso

The Madklubben Shop holds no responsibility regarding any possible delays at Post Danmark.

The Madklubben Shop can’t guarantee, that www.shop.madklubben.dk at all times is fully functional and error free, and the Madklubben Shop can’t be held responsible for any consequences of using www.shop.madklubben.dk, such as internet connection issues and use of outdated PCs and programs.

The Madklubben Shop adds proviso for being sold out, and therefor can’t be responsible for missing delivery of purchases or services, if the missing delivery is due to sold out goods or services.

The Madklubben Shop adds proviso for minor changes in food and beverages ordered by the webshop may occur.

Complaints

If you wish to complain about your purchase, please contact shop@madklubben.dk.
If we are unable to find a solution, you have the opportunity to file a complaint to the Consumer Board of Complaints, Carl Jacobsensvej 33, 2500 Valby, if the conditions for this are met.

Settling in court

Your purchase of any goods or services with us is under all circumstances subject to Danish law, unless otherwise is stated in mandatory rules.

Any disagreements, that we can’t determine amicably, are settled by the ordinary Danish courts, unless otherwise is stated in mandatory rules.
